Privacy Policy

Your privacy is important to us. It is Transmetrics’ policy to respect your privacy regarding any information we may collect from you across our website, https://www.transmetrics.ai, and other sites we own and operate, as well as in our business activities.

GENERAL INFORMATION

TRANSMETRICS AD, as a Data Controller is a company registered with the Bulgarian Commercial Register at the Registry Agency under UIC 203327443, with seat and management address at: 33, Shar planina Str., Vazrajdane District, Sofia 1303, Republic of Bulgaria, represented by Asparuh Asenov Koev (the “Company”, the “Controller” or “TRANSMETRICS”).

CATEGORIES OF CONCERNED INDIVIDUALS (DATA SUBJECTS) AND PURPOSES OF DATA PROCESSING

The below information applies both to Data Subjects who provided their personal data to the Company by themselves and to those whose personal data are provided to TRANSMETRICS by third parties (e.g. their employers).

For the performance of its activities TRANSMETRICS processes personal data of the following main categories of Data Subjects, apart from the data subjects whose data is processed within internal employment and corporate relations:

  • Contractors
  • Clients
  • Individuals using our websites

(I) CONTRACTORS means statutory representatives of general contractors of the Company, their proxies, employees, and contact persons; subcontractors of contractors of the Company, their representatives, contact persons, and employees.

Personal data processed. TRANSMETRICS may process the following categories of personal data of its Contractors: name; personal identification number; address; phone number; signature; ID card data, where the Controller processes Contractors’ ID cards data, only if notary verified documents are used; job position and professional qualification, where needed with regard to the performance of any activities requiring specific qualification.

Purpose, legal basis, and term of processing. The Controller processes the personal data for the purposes of signing and execution of contracts; control over the performance of contractual obligations; property management; accountancy and taxation; debt collection and legal claims defense, business correspondence, including congratulations messages.

The legal basis of the processing is the execution of the contractual, pre-contractual, and statutory obligations of the Controller.

The Controller processes the personal data of its Contractors within a period of up to 6 years after termination of the respective contract or until the closure of dispute related procedures; or up to 11 years for data contained in accounting registers and financial statements and in documents subject to tax audits; except where a legislative act, a judicial act, an agreement or the commercial practice require otherwise.

To whom the personal data have been or could be disclosed. We may disclose the personal data of our Contractors to outside providers of tax and accounting services; expert auditors; outside providers of legal services; service providers supporting the email accounts system used by us and IT service providers; service providers supporting hardware-software systems used by us or our Processors.

 

(II) CLIENTS means statutory representatives of potential, past, and current clients; their proxies, contact persons, and employees.

Personal data processed. TRANSMETRICS may process the following categories of personal data of its Clients: name; personal identification number; signature; ID card/passport data, where the Controller processes Clients’ ID cards/passports data only if such are contained in notary verified documents; job position; professional qualifications where required for the specific contractual performance.

Purpose, legal basis, and term of processing. The Controller processes the personal data for the purposes of signing and execution of contracts; provision of the goods and services provided by the Company to clients; administering the performance of the Company’s contractual rights and obligations; negotiation with current and potential clients of TRANSMETRICS for provision of its goods and services; control over the performance of contractual and pre-contractual obligations; property management; accountancy and taxation; debt collection; legal claims defense; business correspondence, including congratulations messages.

The legal basis of the processing is the execution of the contractual, pre-contractual, and statutory obligations of the Controller.

The Controller processes the personal data of its Clients within a period of up to 6 years after termination of the respective contract or until the closure of dispute related procedures; or up to 11 years for data contained in accounting registers and financial statements and in documents subject to tax audits; except where a legislative act, a judicial act, an agreement or the commercial practice require otherwise.

To whom the personal data have been or could be disclosed. We may disclose the personal data of our Clients to outside providers of tax and accounting services; expert auditors; outside providers of legal services; service providers supporting the email accounts system used by the Controller; courier service providers; other IT service providers; service providers supporting hardware and software systems used by the Controller or its Processors; sub-contractors.

 

(III) INDIVIDUALS USING OUR WEBSITES means individuals subscribed to receive newsletters, participate is webinars, filed applications for downloading of eBook and case study or demonstration queries to TRANSMETRICS; individuals who have sent messages via the web site of the Company or via any social media such as Facebook, Linkedin, and Twitter, where TRANSMETRICS participates; job applicants filing CVs through our website.

Personal data processed.  TRANSMETRICS may process the following categories of personal data of the individuals using our websites: names; email address; phone number; comments and other publications in the web site of the Company and its pages in the social media; job position and company; CVs information of job applicants such as educational background, professional qualification, professional background, information related to commencement of work, including data contained in diplomas and other certificates, data related to the performance of the employment relations, family status, interests, hobby.

Purpose, legal basis, and term of processing. The Controller processes the personal data for the purposes of subscription to receiving the newsletter via the Company’s website; administering and holding of webinars; filling in an application for downloading of eBook and case study; provision of demonstration queries; administration and supporting the pages of TRANSMETRICS in Facebook, LinkedIn, Twitter, and other social media; recruitment and human resources management with regard to job applicants using our websites.

The legal basis of the processing is the legitimate interest of the Company to popularize and advertise its services and activities; the legitimate interest of the Company for its current and future recruitment needs with regard to job applicants using our websites.

The Controller processes the personal data of the individuals visiting our websites within a period of up to 6 years after termination of the respective contract or until the closure of dispute related procedures; or up to 11 years for data contained in accounting registers and financial statements and in documents subject to tax audits; except where a legislative act, a judicial act, an agreement or the commercial practice require otherwise; or for data contained in CVs of short-listed job applicants for a period of up to 6 months after the closure of the specific selection procedure for which they are initially collected and the personal data contained in CVs of non-shortlisted job applicants up to the closure of the procedure for short-listing.

Data contained in marketing databases outside the above cases is processed by the Company for a period of up to 5 years after the closure of the respective marketing campaign or after the receipt of the request for a subscription for direct marketing.

To whom the personal data have been or could be disclosed. We may disclose the personal data of individuals collected through our websites to outside providers of marketing services; joint controllers for specific marketing events co-organizers; outside providers of tax and accounting services; outside providers of legal services; service providers supporting the email accounts system used by the Controller; other IT service providers; service providers supporting software systems used by the Controller or its Processors for marketing purposes.

DATA SUBJECTS RIGHTS

If you are an individual whose data are processed by TRANSMETRICS under any of the above circumstances, you have the following rights with this regard:

(a)   You have the right to object to the processing of your personal data for the purpose of direct marketing if you are an individual, subject to direct marketing. If you file such an objection against direct marketing, we will no longer process your personal data for this purpose. If we use your personal details to contact you with updates about our website and services, along with promotional content that we believe may be of interest to you and you wish to opt-out of receiving promotional content, you can follow the “unsubscribe” instructions provided alongside any promotional correspondence from us.

(b)   All Data Subjects have the right to:

– be informed what kinds of personal data are processed by the Company;

– access and receive a copy of the processed data;

– rectification or erasure of their personal data;

– restrict the processing; and

– data portability.

You may exercise any of your rights above by submitting a written application in any of the following ways:

Please note that your application should contain at least your names and other identification information, description of your request, preferred way of communication with you, address for correspondence, signature, and date of the application.

If the application is signed by a proxy, the respective power of attorney should be attached to the application.

TRANSMETRICS may contact you for additional information if it needs to ensure your identity or further clarify your request.

If we receive any personal data in excesses of what is needed for us to comply with our purposes above, we will delete this information immediately but not later than a month after its receipt.

Use of Personal Data for any other new and/or subsequent purposes, where the consent of the respective Data Subject is needed, may be performed only after obtaining of such for each particular purpose. You have the right to withdraw your consent provided to us at any time.

You have the right to contact a supervisory authority, which for the Republic of Bulgaria is the Commission for Personal Data Protection if you want to lodge a complaint with regard to the processing of your personal data.

 

GENERAL INFORMATION WHEN YOU VISIT OUR WEBSITE

Log data

When you visit our website, our servers may automatically log the standard data provided by your web browser. This data is considered “non-identifying information”, as it does not personally identify you on its own. Our website may link to external sites that are not operated by us. Please be aware that we have no control over the content and policies of those sites, and cannot accept responsibility or liability for their respective privacy practices.

SECURITY OF YOUR INFORMATION

To help protect the privacy of your personal data, we maintain physical, personal, technical, and administrative safeguards. We update and test our security technology on an ongoing basis. We restrict access to your personal data to those employees and personal data processors who need to know that information to provide benefits, goods, or services to you. In addition, we train our employees about the importance of confidentiality and maintaining the privacy and security of your information.

The personal information we collect is stored and processed in Bulgaria or where we or our partners, affiliates, and third-party providers maintain facilities. We only transfer data within jurisdictions subject to data protection laws that reflect our commitment to protecting the privacy of our users.

We only work with external agencies and service providers whose privacy policies align with ours.

Changes to this policy

At our discretion, we may change our privacy policy to reflect current acceptable practices. We will take reasonable steps to let users know about changes via our website. If you are a registered user on https://www.transmetrics.ai, we will notify you using the contact details saved in your account. Your continued use of this site after any changes to this policy will be regarded as acceptance of our practices around privacy and personal information.

The present documents represent privacy notice within the meaning of Art. 13 and Art. 14 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation).
